my first car accident

Sunday, February 15, 2009 at 6:53pm

so, i was in this fender bender in the trader joe's parking lot yesterday. my insurance card wasn't in the car, O keeps it in his wallet. so this woman, this she-devil with a talking mole on her face, verbally assaults me for backing into her when i was pulling out of a parking spot. i didn't see her because she was attempting to go around another car and get out quicker. i'm not disputing that the accident was my fault, i DID back into her. here's the thing though, my little golf cart/car had not a single scratch and her car had maybe a softball size dent. so she gets out, and i'm apologizing profusely, and she proceeds to launch an attack on my charecter.

i did not have the insurance card in my car, (again, my fault) but i offer repeatedly to call the police if she wants to file an accident report, give her my full name, license #, plate #, phone number, address- everything. so she starts saying things like, "i hope they don't have to repaint all this" and "that's going to be expensive to fix" at which point i notice that her honda is far from new. there are several bashes, scrapes, scratches, and even a busted out tail light. it occurs to me that she might try and screw me, so i take out my camera phone and start taking pictures, which enrages her. again weird. she's calling me a deadbeat and saying that i'm going to screw her and try and get out of paying for it. i again offer to call the police. she declines.

i get home, get my policy number, confirm that our insurance is up to date and call her. she calls me back today and leaves me a message saying that maybe we should leave the insurance companies out of it, and she'll get an estimate, and i can just pay her. it makes sense, i mean, neither of us wants an accident on our record or to have our premiums go up. but i feel like something is fishy here... has anyone been in this situation before? is this the way to go? i can't ignore the feeling that i just don't trust her, but i don't want my insurance to go up either. i'm thinking of agreeing to pay her directly, but paying her with a check and writing in the memo line "payment in full for dent, accident 2/14/09" so she can't claim further damages later. legally, i don't get to dictate what she does with the money i pay her, so it's not like i can mandate that she use the money to fix the dent, right? is this a good idea? or should i just leave it up to the insurance companies?
